1. Acceptance of terms
By accessing or using Portugal Property Sale, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.
2. The service
Portugal Property Sale is a platform that helps buyers, sellers, and investors list, search, and manage residential property transactions in Portugal, including tax calculations, legal compliance guidance, and document management. The platform covers residential property only (apartments, houses, villas, and land) and excludes commercial real estate.
3. Eligibility
You must be at least 18 years old and legally able to enter into a property transaction in Portugal to use the platform. You are responsible for providing accurate and truthful information when registering, listing a property, or making an offer.
4. Listings and offers
Sellers are responsible for the accuracy of their listings and for providing valid property documents. Buyers submitting offers confirm their genuine intent to purchase. An offer submitted through the platform is an expression of interest and does not constitute a binding contract until a promissory contract (CPCV) is signed by both parties.
5. Fees
Sellers choose one of two fee options: a flat €500 upfront fee or a 2% commission on the final sale price, deducted from sale proceeds at completion. Solicitor, lawyer, notary, and government tax fees (IMT, stamp duty, capital gains) are paid directly by the parties to their own representatives and authorities and are not included in our fee.
6. Legal and tax compliance
While we provide tools to help with tax calculations and legal compliance, these do not constitute legal or tax advice. You are responsible for obtaining independent professional advice and for ensuring your transaction complies with Portuguese law. We are not a substitute for a licensed lawyer, solicitor, or tax advisor.
7. User conduct
You agree not to misuse the platform, including posting false or misleading listings, submitting fraudulent offers, attempting to access another user's data, or interfering with the platform's operation. We may suspend or terminate access for serious or repeated breaches of these Terms.
8. Intellectual property
The platform, its design, and its content are owned by Portugal Property Sale. Listings, photos, and documents you upload remain your property; you grant us a licence to display and process them as needed to provide the service, including publishing listings on connected social media channels with your consent.
9. Limitation of liability
To the extent permitted by Portuguese law, Portugal Property Sale is not liable for indirect or consequential losses arising from your use of the platform. Our liability for direct losses is limited to the fees you have paid us. We do not guarantee that every listing, offer, or transaction will complete.
10. Governing law
These Terms are governed by the laws of Portugal. Any disputes arising in connection with these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.
11. Changes to these terms
We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page with a new 'last updated' date. Continued use of the platform after changes constitutes acceptance of the updated Terms.
